Booking Our Villa For Your Vacation

Terms & Conditions

Deposit: £80.00 ($120.00) per week is required for each week booked. This is non-refundable in the event of cancellation.

 

Balance: The balance is due two calendar months before your departure date.

 

Payments: Payments can be made by either Direct Bank Transfer, Cheque or PayPal.

 

PayPal Payments: PayPal payments are accepted but will incur a 3% PayPal fee.

 

Security Deposit: A fully refundable £200.00 ($300.00) security deposit is required to cover breakages, damage to the villa or its contents and any exceptional cleaning costs that may be necessary.  This is due with the balance of your holiday and is refunded within 28 days of returning home.  It is important that if you notice any damage to the villa on your arrival, that this is reported to our management company immediately or you may be held liable for the damage.

Cancelation Charges: We must be notified in writing as soon as possible in the event of cancellation. Should you cancel your booking the following conditions will apply:

More than two calendar months;  Deposit forfeited.

Between one and two calendar months before departure;  50% of total cost forfeited.

Less than 28 days before departure;  100% of total cost forfeited.

If the villa can be re-let then 50% is refundable.

We reserve the right to cancel your booking if the balance is not paid by the due date (Cancellation charges still apply).

 

Accommodation: Should circumstances beyond our control require us to cancel a booking the client will receive a full refund of all monies paid to date with no liability accepted or compensation paid.

Only the persons named on the booking form are allowed to stay in the house.

The homeowners and their representative(s) cannot be held responsible for any withdrawal of amenities within the development or any breakdown of equipment/appliances in or around our vacation home during your stay.

 

Liability: During your stay, the homeowners, their representative(s), or owner's agents do not accept any liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused.

Please bear in mind that the villa is situated on a development that consists of both residential and vacation homes. Therefore, the homeowners, their representative(s), or owner's agents, cannot be held responsible for any ongoing construction, alterations to existing houses or any noise or nuisance as a result thereof on or around the housing development. 

 

Force Majeure: The homeowners, their representative(s) or owner's agent cannot accept, be responsible for or be liable in respect of loss, damage or changes caused by Force Majeure (e.g. strikes, floods, terrorist activities, and closure of airports, weather conditions or other events beyond our control).

 

Insurance: You must arrange for your own personal insurance. It is advisable that cancellation insurance is contained within your travel insurance.

 

County Regulations Regarding Noise: Please respect the privacy and peace of our neighboring villas and keep noise to a minimum if using the pool and patio areas between 10.30pm and 8.30am.  If you are unfortunate enough to experience any noise problems yourself, please do not hesitate to contact the local Sheriff.

 

Pool Heat - If applicable:  In the event pool heat is requested and paid for, it is ordered at your own risk. We do not imply and we cannot guarantee the temperature of the pool as this will vary according to several factors, the main one being the prevailing weather conditions/ambient temperature.  In the unfortunate event of a pool heater breakdown, please contact our management company who will try to rectify the problem.  The homeowners and management companies liability will be limited to refunding the pool heat money paid by the guest for the number of proven days the heater is out of action, if the heater cannot be repaired during your stay.  No other action will be taken or compensation paid.

 

Important Information Regarding Pool Heating: If you have booked pool heat it is important that you use the pool blanket at all times the pool is not in use, failure to do this will cause the pool to lose most of its heat that has built up during the day.

How Electric Pool Heaters Work:  Electric pool heaters transfer warm outdoor air to the water via a heat exchanger. The air heats the refrigerant, the compressor further heats the air, the air is eventually compressed into a very hot gas, and a heat exchanger transfers the heat to the pool water. Because heat is not generated but rather transferred, the result is a very efficient use of electricity. However, because heat pumps rely on transferring warm air to the water, they are largely ineffective if the ambient temperatures drop below 60 degrees during the daytime, this is very rare in Florida but does sometimes happen during the winter months.

 

Please see approximate pool temperatures you can expect with different winter air temperatures:
Average Daytime temperature 70-80 degrees, Night time temperature 50-60 = Pool temperature 83-87 degrees
Average Daytime temperature 60-70 degrees, Night time temperature 40-50 = Pool temperature 76-84 degrees

Average Daytime temperature 50-60 degrees, Night time temperature 29-40 = Pool temperature 70-76 degrees

Pool temperatures quoted are from midday until the pool heater turns off in the evening.

Highgate Park noise regulations state that pool heaters are not to run before 8am.
 

Most rental homes will use an electric pool heater as mentioned above and the heaters generally run for approximately 12hrs a day, these are by far more effective than solar pool heating which is really only suitable for the summer months.

As you can see from the above chart, the weather plays a huge part on the pool temperature.  If the weather unfortunately turns cold during your stay and you find that the pool water is too cold for swimming, then if you contact us we can switch the pool heater off for you and refund any remaining full days.  However should the weather improve during your stay we can switch the heater back on for you.  Most people will probably find that they want the temperature of the pool over 80 degrees to swim comfortably. 

State regulations advise that pools should not be heated above 87 degrees as this is the optimum temperature for maintaining a healthy chemical balance of the water, temperatures above this level can cause problems with bacteria in the pool.

 

Distances: All distances and timings are approximate from the US 27 area and will depend on traffic and time of travel.  The homeowners accept no liability if they are not accurate.

 

Insects: Our villa is treated on a regular basis as part of pest and termite control. However, as Florida is a tropical state, the presence of insects is inevitable and is no reflection on the cleanliness of the villa and is no cause for complaint. To minimise their presence inside the villa guests should ensure all windows and doors are kept closed when not in use.

 

Highgate Park rules on permitted vehicles and parking: Please note RV's are not permitted to park in Highgate Park.  All guests vehicles must be parked on the drive, only two cars may be kept at our villa at any time, no curbside parking.

 

Acceptance: The homeowners reserve the right to refuse acceptance of any booking at any time at their discretion without having to give a reason.

 

Complaint Procedure: In the unlikely event of a complaint, please contact our local management company within 24 hours of arrival, who will do their best to assist and rectify the matter as soon as is practically possible. 

It is important that if you notice any significant damage to the villa on your arrival, that this is reported to our management company or you may be held liable for the damage. 

If you have a complaint and the matter is not resolved, you must notify the homeowners in writing within 7 days of your return. 

Failure to follow these procedures will invalidate any complaint. The homeowners will not enter in to any correspondence for any circumstances not brought to our local management company's attention during your stay.

 

Terms & Conditions of Booking:  Upon renting our villa you will be deemed to have agreed to the Terms & Conditions enclosed.  If for any reason the Terms and Conditions of booking change between the party leader signing and your departure date, a copy of the amended Terms will be sent to you.
